Our Site and services are designed for adults (parents, caregivers, and educators). We do not knowingly collect information from or provide services directly to children under 13.

Thumbles provides:

Digital Products:

  • Printable materials and templates

All products are digital only and are delivered electronically. There are no physical products.

Meaningful Play Membership:

  • Subscription-based access to our community platform (hosted on Kajabi)
  • Exclusive content, resources, and educational materials
  • Community features including posts, comments, and member interaction

Access to digital materials is provided immediately upon purchase or subscription activation.

4. Account Creation and Access

To access certain features, products, or the membership community, you may be required to create an account.

You agree to:

  • Maintain accurate and up-to-date information
  • Keep your login credentials secure and confidential

  • Be solely responsible for all activity under your account

We reserve the right to suspend or terminate any account that:

5. Free Trial and Subscriptions

14-Day Free Trial (Meaningful Play Membership):

  • New members receive a 14-day free trial of our Meaningful Play Membership
  • You must provide valid payment information to start the trial
  • You will not be charged during the trial period
  • You may cancel anytime during the trial with no charge
  • If you do not cancel before the trial ends, you will automatically be charged for your chosen subscription plan (monthly or annual)
  • We will send you a reminder email 3 days before your trial ends to remind you of the upcoming charge

Subscription Billing:

  • Monthly subscriptions: Billed monthly on the same date each month
  • Annual subscriptions: Billed once per year on your subscription anniversary date
  • All subscription charges are automatic and recurring until you cancel
  • You authorize us to charge your payment method on each billing date

Cancellation:

  • You may cancel your subscription at any time from your account settings or by emailing [email protected]
  • Cancellations take effect at the end of your current billing period
  • You will retain access to membership benefits until the end of the paid period
  • Cancelling does not automatically generate a refund unless specifically requested under our Refund Policy

6. Payments

Payment Processing:
Payments are processed securely through Stripe or PayPal. By making a purchase or subscribing, you agree to:

  • Provide valid and current payment information
  • Authorize us to charge your payment method for all fees incurred
  • Keep your payment information up to date

Currency:
All prices are listed in U.S. Dollars (USD).

Taxes:
Prices do not include applicable taxes. You are responsible for any sales tax, VAT, or other taxes based on your location.

Price Changes:
We reserve the right to change our pricing. For subscriptions, any price changes will:

  • Take effect at your next renewal date

  • Give you the option to cancel before the new price takes effect

7. Refunds

  • Digital products: Full refunds available within 10 days for defective or malfunctioning files
  • Monthly subscriptions: No refunds for current billing period; cancellation takes effect at period end
  • Annual subscriptions: Prorated refunds available for unused months upon request

8. Intellectual Property

Our Content:

All materials provided through Thumblesā€”including but not limited to text, graphics, images, videos, lesson plans, printables, digital downloads, branding, and educational contentā€”are the intellectual property of Thumble LLC and are protected by copyright and trademark laws.

You may:

  • Use purchased materials for personal, non-commercial use
  • Print materials for your own household use
  • Use materials in a small classroom or homeschool setting with 5 or fewer children

You may not:

  • Reproduce, distribute, sell, sublicense, or share any materials without written permission
  • Modify, adapt, or create derivative works from our content
  • Claim ownership of any content produced by Thumbles
  • Upload our content to file-sharing sites or distribute via email, social media, or other platforms
  • Use our materials for commercial purposes or in large group settings

Violation of these restrictions may result in:

  • Immediate account termination
  • Removal of access to all products and services
  • Legal action to protect our intellectual property rights

User-Generated Content:

When you post content in our Meaningful Play Membership community (including photos, comments, or other materials), you:

  • Retain ownership of your content
  • Grant Thumbles a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content within the community platform and for operational purposes
  • Represent that you have all necessary rights to post the content (including consent if posting about your children)
  • Are solely responsible for all content you post

We may request permission to use member content for marketing or promotional purposes. We will always ask before using your content outside the community platform.

9. Community Participation

Our Meaningful Play Membership community is hosted on Kajabi, a third-party platform.

By participating in the community, you agree to:

  • Follow our Community Guidelines
  • Comply with Kajabi's Terms of Service and policies
  • Respect other members and contribute positively
  • Prioritize child safety and privacy in all posts
  • Take full responsibility for any content, photos, or information you share

We reserve the right to:

  • Monitor and moderate all community content
  • Remove posts that violate our guidelines or compromise safety
  • Warn, suspend, or permanently ban members who repeatedly violate guidelines
  • Report illegal activity or child safety concerns to appropriate authorities

Your community access:

  • Is tied to your active Meaningful Play Membership subscription
  • Ends when your subscription ends (unless you maintain access through the end of a billing period)
  • May be suspended or terminated for violations of our Community Guidelines

10. Safety Disclaimers and Parental Supervision

Important: Our educational materials may include:

  • Physical activities that involve movement, climbing, or coordination
  • Recipes and food-related activities that may involve allergens
  • Sensory activities using small parts that could pose choking hazards
  • Craft projects using scissors, glue, or other tools

You acknowledge and agree that:

  • Constant adult supervision is required for all activities involving children
  • You are solely responsible for assessing whether activities are appropriate for your child's age, abilities, and environment
  • You must evaluate all materials and activities for potential safety hazards before use
  • You are responsible for ensuring a safe environment and preventing injuries
  • Children should never be left unattended during activities
  • You must be aware of and screen for food allergies, choking hazards, and age-appropriate materials

Thumbles is not liable for any injuries, accidents, or adverse reactions that occur during or as a result of using our materials or following our activity suggestions.

11. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purposes or in violation of these Terms
  • Interfere with, disrupt, or damage the Site's functionality or servers
  • Attempt to gain unauthorized access to any part of the Site or other users' accounts
  • Post or transmit harmful, offensive, threatening, or inappropriate content
  • Harass, bully, or harm other users
  • Copy, reproduce, redistribute, or resell any of our digital materials
  • Share your account credentials with others
  • Use automated systems (bots, scrapers) to access the Site
  • Impersonate Thumbles staff or other users

Violation of these prohibitions may result in immediate account termination and legal action.

To the maximum extent permitted by law, Thumble LLC shall not be held liable for any indirect, incidental, consequential, punitive, or special damages arising from:

  • Third-party actions or content (including Kajabi)
  • Injuries or damages resulting from activities in our materials

We make no warranties or guarantees that:

14. Indemnification

15. Dispute Resolution and Chargebacks

If a chargeback is filed:

  • Your access to all Thumbles products and services will be immediately suspended while we investigate

  • If the dispute is resolved in your favor and was legitimate, access may be restored

Filing chargebacks instead of contacting us directly may:

  • Delay resolution of your issue
  • Result in loss of access to your account and purchases
  • Incur additional fees from your payment provider

16. Third-Party Services

Our services integrate with or rely on third-party platforms, including:

  • Kajabi (community hosting)
  • Stripe and PayPal (payment processing)

You acknowledge that:

  • These third parties have their own terms of service and privacy policies
  • Thumbles is not responsible for third-party actions, errors, or service interruptions
  • You agree to comply with all applicable third-party terms when using our services

17. Termination

We reserve the right to suspend or terminate:

  • Your access to the Site or membership community
  • Your ability to make future purchases

Reasons for termination may include:

  • Violation of these Terms or Community Guidelines
  • Fraudulent or abusive behavior
  • Non-payment or chargebacks

Upon termination:

  • You will not receive refunds for unused portions of subscriptions (unless required by law)
